Terms of Service

These Terms of Service (“Terms”) govern access to and use of MailKaka, a transactional email API and hosted business-mailbox platform operated by POLARA VENTURE STUDIO (OPC) PRIVATE LIMITED (“MailKaka”, “we”, “us”). By creating an account, sending email through the API, or using a MailKaka mailbox, you agree to these Terms on behalf of yourself and, if applicable, the organization you represent (“you”, “your organization”).
ACCOUNTS
Your account and organization.
- You must provide accurate information when creating an account and keep it up to date.
- You are responsible for all activity under your organization's account, including actions taken by teammates you invite and by anyone holding your API keys.
- You must keep API keys and webhook secrets confidential. Revoke a key immediately if you believe it has been exposed; we cannot recover a plaintext key once issued, as we store only a one-way hash.
- You are responsible for verifying ownership of any domain you connect to MailKaka for sending or receiving mail.
ANTI-SPAM & ABUSE
Acceptable use.
MailKaka sends email over shared cloud sending infrastructure. Every organization's deliverability depends on the collective sending reputation of that infrastructure, so we enforce a strict acceptable-use standard. You agree not to use MailKaka to:
- Send unsolicited bulk email, spam, or email to purchased/rented/scraped recipient lists.
- Send phishing, malware, or content designed to deceive recipients about its origin.
- Send to recipients who have unsubscribed, complained, or bounced — MailKaka automatically maintains a per-organization suppression list for this purpose and will block sends to suppressed addresses.
- Attach or transmit executable or actively malicious file types; certain file types are blocked or quarantined automatically regardless of declared content type.
- Send content that is unlawful, defamatory, obscene, or that infringes a third party's rights.
- Attempt to circumvent rate limits, quotas, suppression lists, or abuse-detection controls.
- Use the service in a manner that would cause AWS SES or another sub-processor to flag, throttle, or suspend the shared sending infrastructure.
We monitor aggregate bounce and complaint rates per organization and may automatically suspend sending if bounce rates exceed roughly 10% or complaint rates exceed roughly 0.1% over a recent sending window, consistent with industry and cloud-provider deliverability standards. This is an automated safeguard, not a penalty for isolated or explainable events, and a suspended organization can contact us to review and lift a suspension once the underlying issue is addressed.
DEVELOPERS
API usage terms.
- API access is provided under the sending quotas, domain limits, and rate limits of your plan.
- Each API key is scoped to a specific sending domain and permission set; a key will be rejected if the domain is unverified or the key lacks the required permission.
- You are responsible for handling API errors, retries, and webhook signature verification correctly in your own integration.
- You may not resell, sublicense, or expose the MailKaka API as your own undifferentiated service to third parties without our written agreement.
- We may change API behavior with reasonable notice where required for security, legal compliance, or the stability of the shared platform.
PAYMENTS
Billing and plans.
Paid plans are billed in advance through Razorpay on a monthly or annual cycle. Prices shown on the pricing page exclude applicable taxes (e.g. GST) unless stated otherwise. Overage charges, where enabled for your organization, are billed per the rates disclosed on the pricing page at the time of billing. RELIABILITY
Service availability.
We work to keep MailKaka reliably available, but the service depends on third-party infrastructure (including AWS SES/S3/SNS and Razorpay) that is outside our direct control. The service is provided on an “as is” and “as available” basis, without warranty of uninterrupted or error-free operation, except as separately agreed in a signed enterprise agreement or as required by applicable law.
OWNERSHIP
Intellectual property.
- MailKaka, its logo, and the underlying platform, software, and documentation are the property of POLARA VENTURE STUDIO (OPC) PRIVATE LIMITED. These Terms do not grant you any ownership rights in the platform itself.
- You retain all rights to the content you send, receive, or store through MailKaka (email content, attachments, and recipient data). We claim no ownership over it and use it only as described in our Privacy Policy.
- You may not copy, reverse-engineer, or create derivative works of the platform except as permitted by law.
ENFORCEMENT
Suspension and termination.
- We may suspend or terminate your account for violation of the acceptable-use terms above, non-payment, fraud, or legal or security risk to the platform or other customers.
- Where practical, we will attempt to notify you of a suspension and the reason for it.
- You may cancel your account at any time from the dashboard; see the Refund Policy for what happens to billing on cancellation.
- On termination, we retain data per our published retention periods and applicable law, and delete or anonymize the rest within a reasonable period.
RISK ALLOCATION
Limitation of liability.
To the maximum extent permitted by law, POLARA VENTURE STUDIO (OPC) PRIVATE LIMITED and its officers, employees, and sub-processors will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of MailKaka, even if advised of the possibility of such damages. Our total aggregate liability for any claim arising out of these Terms or the service is limited to the amount you paid us for the service in the three months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable Indian law.
JURISDICTION
Governing law.
These Terms are governed by the laws of India. Courts at Kerala, India shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the service, subject to applicable law.
UPDATES
Changes to these terms.
We may update these Terms from time to time. We will update the “Last updated” date above when we do, and will notify account holders of material changes by email or an in-product notice. Continued use of MailKaka after a change takes effect constitutes acceptance of the revised Terms.
